Regular Monthly Town Board Meeting March 19, 2014

CALL TO ORDER.

Supervisor Willman called the meeting to order at 5:30pm. The Pledge of Allegiance was recited and the Town Clerk called the role, noting Councilman Berg was absent but a quorum was present.

HIGHWAY REPORT

Superintendent DeMars reported the Highway Department plowed and sanded when needed and cut shoulders where needed. Men were out with the loader pushing banks back at intersections and making loop holes for run-off. The backhoe and loader were out as well as men with shovels opening up ditches and culverts. Weight limit signs have been posted. Fuel, gas and maintenance sheets have been provided to the Highway Committee.

Highway Committee

Discussion was held regarding the placement of a pole barn to store highway equipment. Councilman Hamm will create specifications for the proposed structure. Superintendent DeMars and the Highway Committee will report back to the full board. Discussion was also held regarding hauling sand out of the closed landfill in Onchiota for use by the Highway Department. The process necessary to do this will be investigated by the Supervisor and Highway Superintendent.

NEW BUSINESS

A. Sand Bid Opening The Town Clerk received 2 sealed bids for sand. Bids were opened by the Supervisor and read aloud. Trudeau Sand and Gravel quoted a price of $4.35 per ton for screened road sand and Graymont Materials quoted a price of $2.75 per ton of washed manufactured road sand. Both quotes specified they meet NYS Department of Transportation requirements.

RESOLUTION #15 Accepting Bids Submitted by Graymont Materials and Trudeau Sand and Gravel

On a motion by Councilman Hamm, second by Councilman Bartiss, BE IT RESOLVED the Town of Franklin accepts the bid submitted by Trudeau Sand and Gravel in the amount of $4.35 per ton of screened road sand and the bid submitted by Graymont Materials in the amount of $2.75 per ton of washed manufactured road sand. As both bids meet NYS DOT requirements, for the purchase of up to 12,000 tons of road sand, BE IT FURTHER RESOLVED that the Town of Franklin Town Board does hereby authorize Superintendent DeMars to purchase up to 12,000 tons of road sand with the amount purchased from each vendor left up to the discretion of Superintendent DeMars.

B. Bloomingdale Fire Department Tim Woodruff, Fire Chief BVFD, requested the department be authorized to use the Town of Franklin's fuel pumps on an emergency basis as the Town of St. Armand's Highway Garage has been demolished. Mr. Woodruff reiterated this would be on an emergency basis only. Superintendent DeMars will instruct Chief Woodruff on the procedure to log fuel usage. The Town of Franklin will bill BVFD accordingly. Chief Woodruff also informed the board the BVFD membership voted no with regard to being included in the proposed Fire District, as proposed by Saranac Lake, at this time. BVFD will continue to be involved in the planning. With regard to the dry hydrants in the Town of Franklin, Chief Woodruff stated the plowing out of the hydrants has been a great help and requested more sand be added to some of the hydrants.

RESOLUTION #16 Authorizing Bloomingdale Volunteer Fire Department to Utilize the Town of Franklin Fuel Pumps for Emergency Purposes

On a motion by Councilman Smalley, second by Councilman Bartiss, BE IT RESOLVED the Town of Franklin Town Board does hereby approve Bloomingdale Volunteer Fire Department to use the Town of Franklin Highway Department's fuel pumps on an emergency basis. Bloomingdale Volunteer Fire Department will be issued two keys to the fuel pumps, will complete the fuel logs when fuel is utilized and, will be billed by the Town of Franklin for the fuel.

TANDEM FINANCING Supervisor Willman reviewed the financing schedule for the 2015 Tandem with Kansas City State Bank. The payment schedule is as follows:

September 1, 2014: $70,873.42
September 1, 2015: $70,873.42
September 1, 2016: $70,873.42

ALCOHOL PERMIT Discussion was held regarding the selling of beer at Town of Franklin sponsored events held on Town property. This would apply to ONLY Town sponsored events and not to any other events, whether public or private, held on Town property.

RESOLUTION #17 Approval of Selling Beer at Town of Franklin Sponsored Events

On a motion by Councilman Bartiss, second by Councilman Hamm, BE IT RESOLVED, the Town of Franklin Town Board does hereby approve of the selling of beer at Town of Franklin sponsored events held on Town property.

OLD BUSINESS

A. Broadband Update Supervisor Willman informed the board the data collection phase has been completed and the data is being analyzed and compiled.

B. 3-Bay Sink Supervisor Willman is researching prices.

C. Lake Clear Airport Contract Supervisor Willman reported the Town has received a voucher from the Town of Harrietstown to receive financial support from the Town of Franklin. The Town Board discussed this while creating the 2014 Town Budget and did not allocate funds for this purpose.

COMMITTEE REPORTS

Audit Final audit of the Tax Collector's records will be performed when Councilman Berg returns from vacation.

Celebration Volunteers are needed for Founder's Day (7/26, 27 rain date), Haunted House (10/31) and Christmas Party (12/20).Haunted House (October 31) and Christmas Party (December 20)

OTHER

Town Clerk Lauren LeFebvre, inquired with Derek Romeo (Kate Mountain Community Recreation Association) as to the process for turning funds raised for Kate Mountain Recreation Park to the Town of Franklin as the group is hosting a fundraising event on June 14 at the Town of Franklin Kate Mountain Recreation Park. Mr. Romeo informed the Town Clerk that the purpose of the group was not to raise money for Kate Mountain Park but rather to raise money for all needs deemed necessary by the group, not necessarily Town of Franklin specific needs or needs of residents of the Town of Franklin. The Town Clerk inquired as to the non-profit status of the group and explained the reason was to justify use of Town property for fundraising purposes not benefiting the Town of Franklin. Mr. Romeo stated the group is incorporated as a nonprofit but has yet to file the paperwork necessary to be designated a charitable organization. Mr. Romeo agreed to provide the Town with the organization's nonprofit documentation.
