1. CALL TO ORDER

Sup. Willman called the meeting to order at 7pm. The Pledge of Allegiance was recited and the Town Clerk called the roll and stated the full board was present.

2. QUESTIONS & COMMENTS

Mary Ellen Keith stated the first Founder's Day was held in 1996. All residents were encouraged to be part of the planning process. Mrs. Keith noted that the 2013 Founder's Day is being sponsored by the Town of Franklin Democratic and Republican Committees. Mrs. Keith asked whether Founder's Day is now a political event and taxpayer money is being spent on this event. Supervisor Willman responded the 2013 Founder's Day is a fundraiser for Kate Mountain Park Special Reserve Fund. The two parties have been asked to sponsor the event because, as a town government, the Town of Franklin cannot raise funds outside of property taxes. Many items have been donated and what has not been donated has been paid for by the cash contributions from the sponsors and/or individual cash contributions. Supervisor Willman stated anyone wishing to provide information on previous Founder's Day events or assist with this and/or upcoming Founder's Day events is very welcome to do so.

Cynthia Martino inquired as to whether there is a plan to repair Blue Spruce, Oak Lane and County Route 26. Ms. Martino added that she is aware that Route 26 is a Franklin County road. She and other concerned residents have called County Superintendent John Hutchins but have not received a response. Ms. Martino reported that the old Loon Lake Golf Club House, occupied by Carol Long, has been flooded out a number of times this season. Supervisor Willman stated that County Route 26 and the Blue Spruce/Oak Lane intersection are scheduled to be repaired by September 2013. Town of Franklin Deputy Highway Superintendent stated the town has assisted with the flooding issue when they are notified. It was agreed that the scheduled repairs should rectify much of the current problems. Supervisor Willman will keep the Loon Lake Homeowners Association apprised of the situation as plans become more definite.

8. HIGHWAY REPORT

A. Superintendent's Report

Fletcher Farm-Prep work has started where paving is planned.
• Roadside mowing has started.
• Sent trucks and men to assist Town of Saranac to repair several of their roads due to washouts.
• Faxed salt agreement to Franklin County.
• Repaired section of Alder Brook Rd shoulder and reditched that area.
• Hauled one load of sand to rec park and sent one man to assist there for two days.
• Request to solicit bids for 12,000 tons road sand

Resolution #31 Resolution to advertise for Road Sand Bids

Whereas; Highway Superintendent Jacques DeMars has requested the Town Board solicit bids for 12,000 tons of road sand to meet New York State Specifications; therefore, BE IT RESOLVED that the Town Clerk be authorized by the Town of Franklin Town Board to advertise for sealed bids for the purchase of 12,000 tons of road sand and BE IT FURTHER RESOLVED that sealed bids will be opened at the regular monthly board meeting to be held August 14, 2013

Resolution #32 Solicit Bids for Two New Pedestrian Entrances at Highway Garage

Whereas; it has been determined that the Town of Franklin Highway Garage is need of two new pedestrian entrances, BE IT RESOLVED that the Town Clerk be authorized to solicit sealed bids for two new entrances at the Town of Franklin Highway Garage. BE IT FURTHER RESOLVED that the Town Clerk shall solicit bids upon receipt specifications.

Resolution #33 Accept Resignation of Town Clerk Sandra Oliver

Whereas Sandra Oliver has served as Town of Franklin Town Clerk since 2004 and Whereas Sandra Oliver has properly notified the New York State Office of the Secretary of State and the Franklin County Clerk of her resignation, therefore BE IT RESOLVED that the Town of Franklin Town Board accepts the resignation of Sandra Oliver as Town of Franklin Town Clerk effective July 10, 2013.

Resolution #34 Appoint Lauren LeFebvre as Town Clerk

Whereas, upon a vacancy in the office of Town Clerk, the Town Board is required to appoint a qualified individual to serve the remainder of the unexpired term when the vacancy occurs in an election year, therefore BE IT RESOLVED that the Town of Franklin Town Board does hereby appoint Deputy Town Clerk Lauren LeFebvre to the office of Town Clerk for the remainder of Sandra Oliver's unexpired term, December 31, 2013.

Resolution #35 Accept Lauren LeFebvre's Resignation from BAR Whereas, Lauren LeFebvre has served on the Board of Assessment Review for nine years and Whereas, members of the BAR cannot be paid employees of the Town of Franklin, BE IT RESOLVED that the Town Board of the Town of Franklin accepts the resignation of Lauren LeFebvre from the Board of Assessment Review.

Resolution #35 Authorizing Signatory Change for Town Clerk and Tax Collector Bank Accounts

Whereas, Lauren LeFebvre has been appointed Town Clerk/Tax Collector BE IT RESOLVED that the Town of Franklin Town Board does hereby authorize Lauren LeFebvre to be the signatory on the Town Clerk and Tax Collector bank accounts at NBT Bank.

Whereas the Town Clerk has been charged with the duty of serving as Registrar of Vital Statistics and Fixed Asset Officer for the Town of Franklin for a number of years BE IT RESOLVED that the Town of Franklin Town Board hereby appoints Lauren LeFebvre Registrar of Vital Statistics and Fixed Asset Officer.

10. OLD BUSINESS.

A. DEFIBRILLATOR UPDATE. Supervisor Willman reported he is in the process of coordinating Defibrillator/Heart Saver CPR training for town employees during the workday and an additional training that will be free and open to the community.

A. Defibrillator Update: No Update

B. Bigelow Rd: Sup. Willman has consulted the town's attorney and has been advised that, because the adjacent landowners on Bigelow Road is the State of New York, it would be in the best interest of the Town not to close Bigelow Road to vehicle traffic as there is a provision in the law in which the state can then take ownership of the road and close it to all traffic thereby preventing ATV's and pedestrians from presuing recreational activities such as fishing, birding, etc. The attorney suggests the town work with DEC to remedy the dumping problem.

C. Amending Local Garbage Law:The Town's attorney has advised the town that the amendment the town would like to propose can be handled by the Code Enforcement Officer as property owner trash is covered until NYS Building Code Law.

D. Land Inventory:Supervisor Willman and Councilman Smalley will tour town properties.

E. Oil-Water Separator:Installation of a hydrant for an outside wash station was discussed. The board will seek expert advice on how this can be accomplished.

F. Water Filtration System: Supervisor Willman announced the following quotes have been received:

Resolution #37 Select Vendor for Water Filtration System at Town Hall

Whereas the Department of Health has notified the Town of Franklin that a water filtration system must be installed at the Franklin Town Hall and whereas, Culligan has meet the specification requirements for the system and has also provided the lowest quote, therefore BE IT RESOLVED that the Town of Franklin Town Board selects Culligan to install the water filtration system at the Town of Franklin Town Hall.

13. ANNOUNCEMENTS.

Mary Ellen Keith announced the 55+ club is planning a trip to the Adirondack Museum on August 25. Supervisor Willman suggested Vince Pagano be notified so this event can be included in the upcoming special edition of the Town newsletter. Mrs. Keith also thanked the Town for its condolences on the loss of her daughter, Susan Muzzy.

15. ADJOURNMENT.
