1. CALL TO ORDER

Supervisor Willman called the meeting to order at 7:00pm. The Pledge of Allegiance was recited; the Deputy Town Clerk called the roll and stated the full board was present.

9. HIGHWAY REPORT

A. Superintendent's Report

Highway Superintendent Demars submitted a written report. All road posted signs have been taken down. Goldsmith Road-Cut shoulders, screened and saved useable material. FEMA work is completed. Roads Raked-All with the exception of Blue Spruce Drive, Yamassee Lodge Road and Kushaqua-Mud Pond Road. Traffic Counters Updated Numbers-Fletcher Farm Road 6720, Franklin Falls Hill 1610. This is for the period May 6-May13. Trees and debris have been removed from roadways as needed. Two sections of French Road and a few sections of Goldsmith Road had to be repaired due to washouts. Superintendent DeMars requested the Town Board seek bids for up to 12,000 tons of winter road sand.

B. Highway Committee Report

Councilmen Hamm and Berg discussed the condition of Fletcher Farm Road and Alder Brook Road. It was agreed the Fletcher Farm is the current priority. It was also noted that there is FEMA related work still to complete in the Town of Franklin.

C. Update Agreement with Franklin County for Summer Mowing

The Town Board reaffirmed the agreement to perform summer mowing on Franklin County Roads in the Town of Franklin. (C.Smalley-A.Berg m/s/p) All Aye

10. NEW BUSINESS

A. Open Bids for Pavement Grinder

The Deputy Town Clerk stated one bid was received. The sealed bid from Asphalt Zipper was opened and the Deputy Town Clerk stated the bid was in the amount of $164,990.00. (C.Smalley-A.Berg m/s/p) 4 Aye, Willman, Berg, Hamm, Smalley. 1 No, Merrill

Resolution #26

Whereas the Town of Franklin Town Board has duly solicited bids for a Portable Asphalt Grinder and; Whereas Asphalt Zipper has submitted a bid that meets the specifications set forth by the Town of Franklin Town Board; Be it Resolved that the Town of Franklin Town Board does hereby accept the bid in the amount of $164,990.00 as submitted by Asphalt Zipper, PO Box 750, Pleasant Grove, UT 84062 to be purchased jointly by the Town of Franklin and the Town of Harrietstown.

Grinder Financing-Councilman Berg moved to approve the financing agreement with Kansas State Bank of Manhattan for the purchase of the Road Grinder from Asphalt Zipper. (A.Berg-C.Smalley m/s/p) 4 Aye. Willman, Berg, Smalley, Hamm. 1 No. Merrill

Resolution #27

Whereas the Town of Franklin Town Board has accepted the bid in the amount of $164,990.00 from Asphalt Zipper for the purchase of a Road Grinder and; Whereas financing for the purchase has been arranged through Kansas State Bank of Manhattan; Whereas the following payments and dates have been set forth:

July 20, 2013: $35,360.00
January 20, 2014: $35,360.00
January 20, 2015: $35,360.00
January 20, 2016: $35,360.00
January 20, 2017: $35,360.00

Be it Resolved that the Town of Franklin Town Board does hereby approve Supervisor Arthur Willman to sign the finance agreement, with Kansas State Bank of Manhattan for the purchase of a Road Grinder from Asphalt Zipper for a purchase price of $164,990.00.

Supervisor Willman stated, as per the agreement with the Town of Harrietstown, the Town of Franklin will make the first two payments, the payment due January 2015 will be split between the Town of Franklin and the Town of Harrietstown and the final two payments will be made entirely by the Town of Harrietstown. The interest will be applied as follows:

Councilman Merrill was not in favor of the Town of Franklin's portion of the applied interest.

B. Review bids for Town Hall water treatment system.

Supervisor Willman presented the following quotes for the installation of a water treatment system at the Franklin Town Hall:

Culligan: $4020.00
Steve Light: $$4630.00
Snickles: $4500.00

The board requested Supervisor Willman obtain more information regarding the cost of yearly maintenance for the system.

C. Amendment to Local Law #1 of 2002 —Prohibition of Improperly Stored Garbage. The Town has not received the language from the Town Attorney therefore the amendment will not be introduced at this time.

D. Barbara Rice. Not in attendance.

E. Esther Arlen. Esther Arlen and Peter Benson, Director of the Saranac Lake Free Library, presented a program to the Town Board in which the Saranac Lake Free Library would supply books to the Town of Franklin residents using space at the Franklin Town Hall. The books would be free of charge and need not be returned. The SLFL would monitor the program, keeping the books stocked accordingly. The Town would supply space and shelves. Deputy Town Clerk, Lauren LeFebvre, requested (if the board approved the program) that the shelving unit be mobile as space in the Town Hall is very limited. (B.Merrill-A.Berg m/s/p) All Aye

Resolution #28

Whereas the Town of Franklin Town Board acknowledges the loss of easily available reading free material due to the discontinuation of the Clinton/Franklin/Essex County Bookmobile services; Be it Resolved that the Town of Franklin Town Board does hereby approve space to be utilized at the Franklin Town Hall for the purposes of a “Little Library” program to be coordinated in conjunction with the Town Clerk's Office.

F. 211 Wavier for Bob Snickles. (C.Smalley-A.Berg m/s/p) All Aye

Resolution #29

Whereas, Robert Snickles, an employee of 8 years, a Motor Equipment Operator (MEO) in the Highway Department and retired as a Corrections Officer; and Be it Resolved, the Town Supervisor is hereby authorized to request a Waiver of the income cap under Section 211 for Robert Snickles.

G. Rental Space at the Town Hall. Supervisor Willman requested board approval for the rental of space at the Franklin Town Hall to Friend Commercial Construction for use as a Field Office for the duration of the project to replace the bridge in Franklin Falls. (B.Merrill-A.Berg m/s/p) All Aye

Resolution #30

Whereas the Town of Franklin has been approached by Friend Commercial Construction, the contractor selected to replace the bridge in Franklin Falls, requesting utilize rental space to house a Field Office for the duration of the bridge replacement project therefore; Be it Resolved that the Town of Franklin Town Board does hereby approve renting space at the Franklin Town Hall to Friend Commercial Construction in the amount of $500 a month.

H. Noelle Bergmann. Ms. Bergmann expressed her embarrassment regarding the condition of Bigelow Road. Ms. Bergmann read an excerpt from a book entitled “Adirondack Birding” in which Bigelow Road in the Town of Franklin is specifically mentioned as recommended site to view Black-Backed Woodpeckers. Ms Bergmann added that birding is a popular type of recreation that, under the right conditions, could bring money into the Town. Ms. Bergmann requested that Town come up with a solution to the dumping and road rutting conditions on Bigelow Road. Supervisor Willman will look into possible solutions.

11. OLD BUSINESS.

A. DEFIBRILLATOR UPDATE. Supervisor Willman reported he is in the process of coordinating Defibrillator/Heart Saver CPR training for town employees during the workday and an additional training that will be free and open to the community.

B. Update: Additional Storage Space at Vermontville Garage. No update.

C. Progress: Land Inventory No update.

D. Progress: Oil-Water Separator. No update.

12. COMMITTEE REPORTS

A. AUDIT.

No report.

B. CELEBRATION.

Founder's Day is being coordinated. Volunteers, Vendors and, Donations are welcome.

C. CEMETERY.

Surveying of Merrillsville Cemetery has been completed. Lee Foster needs topsoil and sand.

14. ANNOUNCEMENTS.

A. Supervisor Willman announced the Board of Assessment Review will have two vacancies to fill in September.

B. Town Clerk, Sandra Oliver, reported 31 dogs and 6 cats received Rabies Vaccinations at the free clinic held at the Franklin Town Hall on June10.

C. Supervisor Willman acknowledged the recent loss of three residents of the Town of Franklin, Francis LaBrake, Susan Muzzy and, Charles Alexander and expressed condolences to their families on behalf of the Town.
