SEPTEMBER 18, 2018, Town Board Meeting

CALL TO ORDER:
Supervisor Willman called the meeting to order at 5:30pm. The Pledge of Allegiance was recited and the Town Clerk called the roll, noting the full board was present.
PURPOSE OF SPECIAL MEETING
Supervisor Willman stated he has spoken to legal council for the Association of Towns as well as Edward Murphy, the Town of Franklin's attorney, both have informed him the acceptance of the proposal for mowing at the September 12 meeting must be rescinded as the proposals were not obtained according to the Town of Franklin Procurement Policy and Section 103 of General Municipal Law. As per the Town's policy, goods/services in the amount of $20,000+ must be obtain via sealed bid. The Town Clerk provided a copy of the legal notice in which sealed bids, not proposals, were solicited. Supervisor Willman stated, according to General Municipal Law, sealed bids must be opened publicly and the bids did not include insurance and non-collusive bidding agreements. Councilman Smalley stated the solicitation for sealed bids did not require insurance and a non-collusive bidding agreement be included in the sealed bid as the legal notice read “Successful Bidder must have appropriate insurance and provide a Non-Collusive Bidding Agreement”. Discussion was held regarding whether the Town of Franklin should require the successful bidder for cleaning be bonded.
RESOLUTION #38 REBID 2019 GROUNDS KEEPING AND CLEANING
-On a motion by Supervisor Willman, second by Councilman Hamm, BE IT RESOLVED the Town of Franklin Town Board does hereby rescind Resolution #35 and rejects all bids received for Grounds Keeping and Cleaning and BE IT FURTHER RESOLVED the Town Clerk is authorized to publish legal notices soliciting Seal Bids for 2019 Grounds Keeping and 2019 Cleaning Services with Sealed Bids being received by the Town Clerk by 2pm on October 1, 2018 and opened at a Special Meeting of the Town of Franklin Town Board on October 1, 2018 at 5:30pm at the Franklin Town Hall.

- Highway Superintendent Jacques DeMars was not in attendance but submitted correspondence to the Town Clerk delineating past work performed by the Highway Department at the request of the Supervisor as well as duties that were previously the responsibility of the Highway Department. Supervisor Willman will schedule a meeting with Superintendent DeMars to draft a Memorandum of Understanding regarding the tasks his department will resume responsibility for.
Freeze Alarm -Councilman Bartiss requested the Town purchase a Freeze Alarm to be installed at the Franklin Town Hall. He explained the alarm can be programmed to alert necessary personnel when there are dangerous temperature changes in the building.
There being no further business, Supervisor Willman adjourned the meeting at 6:15pm.
