Special Meeting - Monthly Board Meetings August 10, 2022 5:30PM

BOARD MEMBERS PRESENT:

Supervisor Dorothy Brown, Council Member Richard Jarvis, Council Member Leo Demong, Council Member Gail Huston and, Council Member Rachelle Waters

OTHER PRESENT:

Brian Tremblay—Barton & Loguidice, Jacques DeMars—Highway Superintendent and Lauren LeFebvre—Town Clerk

CALL TO ORDER

Supervisor Brown called the meeting to order at 5:30pm. The Pledge of Allegiance was recited and the Town Clerk called the roll, noting a quorum present.

PUBLIC COMMENT/INFORMATIONAL SESSION

Brian Tremblay discussed replacing the Swinyer Road Bridge over Lyon Brook. The Town was awarded a one million grant for the project. Any costs over the grant award will be assumed by the Town of Franklin. The estimated closure/detour of the road will be approximately 16-20 weeks. Mr. Tremblay was in attendance until 7pm.

HIGHWAY SUPERINTENDENT'S REPORT - Superintendent DeMars presented the following report:

  • Assisted towns and villages; Saranac, Constable, Burke, Village of Tupper Lake and Town of Tupper Lake
  • Mowing continues
  • Worked on Keith Rd prepping for paving. Franklin County assisted with a couple large stones
  • Installed kiosk as requested by town board
  • Had 2 radios installed in the 2 newest trucks. The new radio was ordered in Dec. 2021
  • Took truck with water tank to rec park for the bike course as well as loader as requested by Town Board to assist the pump track developer
  • Cut shoulders on sections of Keith Rd and Kushaqua- Mud Pond 284 for Keith Rd
  • Received check from Franklin County as per Snow and Ice Contract
  • On going beaver activity around town
  • Fuel and gas sheets were given to the Town Clerk

RESOLUTION #24 APPROVAL OF EXPENDITURE OF HIGHWAY FUNDS 284
On a motion by Council Member Jarvis, second by Council Member Demong, BE IT RESOLVED that the Town Board of the Town of Franklin does hereby approve of the expenditure of up to $160,000 for permanent improvements of approximately 1.1 miles of road beginning at the Cold Brook intersection to the end of the road.

NEW BUSINESS

A. Sand Bids - The Town Clerk stated three bids were received:
Peru Sand and Gravel-$5.00 per yard
Upstone-$5.75 per ton of manufactured sand and $3.75 per ton for stone dust
Trudeau-$6.50 per ton
Superintendent DeMars requested all bids be accepted and approval to utilize all three as necessary.

RESOLUTION #25 AWARD 2022 SAND BID
On a motion by Supervisor Brown, second by Council Member Waters, BE IT RESOLVED that the Town of Franklin Town Board does hereby accept the following bids: Peru Sand and Gravel-$5.00 per yard Upstone-$5.75 per ton manufactured sand and $3.75 per ton stone dust Trudeau-$6.50 per ton AND BE IT FURTHER RESOLVED that the Town of Franklin Town Board authorizes the Highway Superintendent to purchase up to 13,000 tons of road sand as needed from Peru Sand and Gravel, Upstone and Trudeau Sand and Gravel.

OLD BUSINESS

A. DASNY - No Update

B. Park Building - Supervisor Brown reported she anticipates the building being completed by the end of September.

C. Pump Track - Council Members Waters and Huston reported the beginner pump track has been completed. The advanced track is currently on hold. Volunteers are greatly needed.

D. CDBG - Supervisor Brown reported all but two projects have been completed.

E. Kate Mt. Park - Supervisor Brown reported she is working with Spectrum to provide security cameras and a wifi hotspot at the park. The approximate monthly increase in price will be $225.

RESOLUTION #26 INSTALLATION OF SECURITY CAMERAS AND WIFI AT KATE MT PARK
On a motion by Council Member Huston, second by Council Member Demong, BE IT RESOLVED that the Town of Franklin Town Board does hereby approve the installation of security cameras and open wifi at Kate Mt. Park.

F. Streetlights to LED - Council Member reported he and volunteer Richard Brandt have located all the streetlights in the Town of Franklin. Council Member Jarvis presented a draft Streetlight Policy which will be discussed at the September meeting.

COMMITTEE REPORTS

A. Recreation - Resident Brett McLeod has approached the Town regarding possible trail projects in the town that could be undertaken by students from Paul Smiths College. Because Kate Mountain is part of the DeBar Unit Management Plan, which has been in process since the 1980's, the Town Board would like to speak with a representative from APA as the Town is not in a position to discuss trail improvements until the UMP is finalized.

B. Youth Program - Supervisor Brown reported the program ends of August 12. The town will create a committee to overhaul the program to ensure the needs of Town of Franklin residents are met.

C. Newsletter - Council Member Huston reported the newsletter is completed and is currently at the printer. She plans on creating a special edition devoted to Kate Mountain Park history and plans for its future.

C. Broadband - Council Member Demong reported the Hudson Valley Wireless project to place a tower on Norman Ridge Road will not be proceeding. HVW is now researching placing a tower on Whiteface Mountain. Council Member Demong and Supervisor Brown will continue to work with local broadband provider Adirondack Broadband. Supervisor Brown will speak to the Loon Lake Homeowners Association regarding the possibility LLHA could provide some financial assistance for the project. Council Member Waters is in process of writing a grant for broadband funding through the federal Rural eConnectivity Program.

EXECUTIVE SESSION

Supervisor Brown moved, second by Council Member Huston, the board enter into executive session at 7:30 pm to discuss an employee issue. Present were Supervisor Brown, and Council Members Jarvis, Demong, Huston and, Waters. The board moved out of Executive Session at 7:55pm.

RE-OPEN REGULAR MEETING

Supervisor Brown stated no action was taken in Executive Session and moved to approve an employee's request to submit Salary Wavier Form 211 to the NYS Retirement System, with the stipulation the form be corrected to reflect the accurate start/end dates of employment.

RESOLUTION #27 APPROVAL TO SUBMIT FORM 211
On a motion by Supervisor Brown, second by Council Member Waters, BE IT RESOLVED that the Town of Franklin Town Board does hereby approve of the Town's submission of Wavier Form 211 to the NYS Retirement System allowing a retired employee to be paid more than the stipulated legal maximum, as set by the NYS Retirement System, yearly salary for two years and will expire in late 2023.

ADJOURNMENT

There being no further business to discuss, Supervisor Brown adjourned the meeting at 8pm.
